These conditions form an inseparable part of and apply to all offers, reservations and agreements provided by Kasteel Steenenburg Exploitatie B.V. (hereinafter also referred to as: 'Kasteel Steenenburg') with respect to all accommodation and other (rental) facilities at the location (including the catering and meeting rooms in Kasteel Steenenburg) and to all other services and products offered by Kasteel Steenenburg (in connection with) the rental ("the Catering Services"). Kasteel Steenenburg is located at Gravin 38 (5253 CJ) in Nieuwkuijk and registered with the Chamber of Commerce under number 88049140. Kasteel Steenenburg reserves the right to change these conditions of stay.
The most recent version of the UVH terms and conditions are an integral part of these terms and conditions. The UVH terms can be accessed at www.khn.nl. If the UVH terms conflict with these terms of residence Kasteel Steenenburg then (contrary to any provisions thereon in the UVH terms) the terms of residence Kasteel Steenenburg shall prevail.
The most recent version of the Kasteel Steenenburg house rules (www.kasteelsteenenburg.nl/huisregels) are integrally applicable.
The following terms are further used in this Agreement:
"Hospitality Service": The provision of accommodation and/or food and/or drink and/or the provision of (hall) space and/or grounds, all with all related activities and services, and all in the broadest sense of the word;
"Main booker": the person who (also on behalf of any (co-)guests) enters into an agreement with Kasteel Steenenburg regarding rental/use of the Hospitality Services;
"Guest(s)": the Main Booker and/or the persons (if any) specified by the Main Booker who (with the consent of Kasteel Steenenburg) use (or may use) the Catering Services;
"Flexible rate.": rate where cancellation and changes are free of charge up to a certain date before the start of a reservation/booking;
"Non-refundable rate": rate for a reservation that can no longer be canceled or changed and where the charges are in principle always due.
These terms and conditions apply to the exclusion of other terms and conditions, regardless of prior reference thereto. Terms used by Main Booker are expressly rejected.
Deviations from these conditions are valid only if made in writing and signed by Castle Steenenburg and Main Booker with agreement.
Kasteel Steenenburg only accepts reservations from persons 18 years of age or older. Minors are not allowed to stay in the accommodation without being accompanied by an adult (at least 18 years old).
The lodging accommodation can accommodate a maximum of the number of people indicated on the website (from 3 years of age).
A preference for a particular location or type of accommodation may be expressed at the time of booking. Staying in an accommodation with a certain preference (e.g. for location) may incur additional costs. The final price depends on the date of stay and preferences. Kasteel Steenenburg reserves the right to deviate from a stated preference.
Kasteel Steenenburg is located in a peaceful setting that inspires and enriches and provides space for business meetings and intimate celebrations. Groups of young people unaccompanied by an adult (at least 18 years old) are not admitted. For each reservation, we reserve the right to refuse reservations without giving reasons, especially reservations from groups or parties that we consider to be in conflict with our target group, or to impose special conditions, such as requiring a deposit.
An agreement is established between Main Booker and Kasteel Steenenburg when the reservation is accepted by Kasteel Steenenburg. There is no legal reflection period. The agreement cannot be revoked. For cancellation and changes, please refer to article 5 of these terms and conditions.
If no (written) confirmation/invoice has been received within 10 days of making the reservation, please contact Kasteel Steenenburg as soon as possible at telephone number 073-2121290 or via the contact form (www.kasteelsteenenburg.nl/contact), failing which the reservation cannot be invoked.
Kasteel Steenenburg reserves the right to make changes in the set-up and opening hours of the facilities of the Hospitality Services including, but not limited to, the gym and the catering facilities. This includes partial or total closure of these facilities. As a result, Main Booker or Guests shall not be entitled to any compensation.
The agreement concerns rental of accommodation(s) and/or other facilities for business or recreational use, which by its nature is of short duration. The same applies to the other related services and products offered by Kasteel Steenenburg.
The booking fee must be paid in full immediately upon booking. In case of payment by credit card, the amount due will be collected immediately in case of Non-refundable rate and in case of flexible rate will be reserved and collected 7 days before arrival date.
Payment(s) will be confirmed upon receipt. If Kasteel Steenenburg has not received the payment(s) on time, the right is reserved to cancel the reservation in accordance with these conditions.
Kasteel Steenenburg shall always be entitled to set off claims against the Main Booker and/or Guests on any account against amounts paid by the Main Booker and/or Guests on any account.
To Kasteel Steenenburg the agreed rental price and the price of other catering services and/or products purchased, as stated in the written confirmation (also invoice) of the reservation, shall be due in any case.
In addition to the rental price and price of other services and/or products purchased, any reservation fees and tourist tax are also payable.
After booking one or more Hospitality Services, there is no right to special prices, discounts or promotional rates.
All prices, where applicable, include VAT unless otherwise stated.
Cancellations or changes should always be made in writing or by email.
If after the formation of the booking the Main Booker or Guests wish to make changes, Kasteel Steenenburg is not obliged to cooperate. Changes may be subject to charges.
The Main Booker and/or Guests are not permitted to cede the Catering Services under any denomination and for any reason to other persons for their use, unless otherwise agreed in writing with Kasteel Steenenburg
If the Main Booker and Kasteel Steenenburg have agreed that the Main Booker and/or one or more Guests will be replaced, the Main Booker shall remain jointly and severally liable to Kasteel Steenenburg, in addition to the other Guests who replace the Main Booker and/or other Guests, for the payment of at least the outstanding portion of the booking price, the alteration costs referred to in Article 5 of these terms and conditions and any additional costs resulting from the replacement and any cancellation costs.
- Cancellation Hospitality Services -
If the Main Booker wishes to cancel the reservation, then, notwithstanding the provisions of the UVH terms and conditions, this is free of charge up to 7 days prior to arrival, unless it is a Nonrefundable rate. If a reservation made at a Non-refundable rate is cancelled, there is no right to a refund of the agreed fee.
If there is a Flexible Rate, the compensation for cancellation within 7 days before the arrival date or in case of no-show (on time) is 100% of the total price mentioned in the confirmation.
With a Non-refundable rate, in case of cancellation or failure to appear (on time), 100% of the total price stated in the confirmation is always due.
Failure to check in by 8:00 pm on the agreed arrival date without further notice will be considered a 'no-show'. The reservation will then be settled as a cancellation according to article 5 of these terms and conditions. The fee according to the conditions of 'no-show' will then apply. Moreover, Kasteel Steenenburg is then free to make the accommodation available to another person.
- Change Hospitality Services -
When applying a Non-refundable rate, changes are not possible.
If a Flexible Rate applies then changes can be made up to 7 days prior to arrival. If changes result in an additional price, the excess is due immediately. If the changes result in a lesser price then the difference will be refunded by Castle Steenenburg (using the same payment method and to the same account number as used for the original reservation).
Changes within the period of 7 days before arrival date will be considered a cancellation of the existing reservation for which a fee of 100% of the total price stated in the confirmation will be due by Guests.
Reducing the number of Guests is possible up to the minimum occupancy per accommodation. This concerns persons from 3 years of age and up.
- Changes during the stay -
If the agreement with Kasteel Steenenburg is to be extended for longer than the agreed duration and Kasteel Steenenburg agrees to this then, in addition to an additional fee for the Catering Services and tourist tax, change fees may also be due. Kasteel Steenenburg is always entitled to designate another accommodation. For stay of additional persons a surcharge is due plus tourist tax. Shortening the length of stay or reducing the number of persons does not entitle Castle Steenenburg to compensation.
All Guests who (will) stay in the accommodation must register through a personal digital environment ("Guest Portal"). The Main Booker is required to do so. The Main Booker will receive this request (for all guests) digitally prior to arrival.
Legitimation on the premises of Kasteel Steenenburg is mandatory. Kasteel Steenenburg has the authority to check Guests present in the accommodation on the basis of their proof of identity. If Guests cannot show valid identification, Kasteel Steenenburg may decide not to accommodate these Guests, without any right to refund or compensation
- Arrival and departure accommodation -
At Kasteel Steenenburg, arrival or departure for all accommodations is in principle possible on all days. On certain days a minimum length of stay applies. You can enter your accommodation on the day of arrival in principle from 15:00 and on the day of departure you must check out before 11:00.
On the day of arrival the facilities in Kasteel Steenenburg can already be used. For the applicable rules, please refer to article 1.3 of these terms and conditions.
Reservations are always made for fixed arrival and departure dates or, in the case of specific Catering Services, for the moment chosen for them at the time of reservation. Later arrival at or earlier departure from the accommodation does not affect the total travel price and therefore no refund can be claimed in the event of earlier departure or later arrival. Failure to check in by 8:00 p.m. on the agreed arrival date without further notice will be settled as a "no-show" according to Article 5.
Pets are not allowed, with the exception of (assistance) dogs (see house rules for that). (Assistance) dogs are allowed in only a few accommodations. Letting an (assistance) dog stay in the accommodation must be notified directly at reservation. A non-refundable fee ("pet fee") per dog per night will be charged for your dog(s) staying in the accommodation.
At Kasteel Steenenburg, (assistance) dogs (subject to house rules) are allowed only on the terraces and in the lounge. Kasteel Steenenburg reserves the right - without giving reasons - to refuse dogs at the location.
The Main Booker and guests are jointly and severally liable for the orderly conduct of business in and around the rented accommodation or elsewhere on the grounds of Kasteel Steenenburg. They are also jointly and severally liable for the proper use of the accommodation and the equipment and inventory therein.
In addition, the Main Booker and Guests are always jointly and severally liable for damage due to breakage and / or loss and / or damage to inventory and / or accommodation whether resulting from acts or omissions of Main Booker, Guests or third parties with the consent of in the accommodation. Any damage must be reported immediately by the Main Booker or Guests to the reception of Kasteel Steenenburg and immediately compensated on the spot, unless the Main Booker can prove that the occurrence of the damage is not due to fault of himself, other Guests or any of the members of his party. If Castle Steenenburg requires a damage report to be drawn up or ordered, the costs will be charged after the stay.
Main Booker and Guests shall indemnify Castle Steenenburg against all claims for damages from third parties which are (partly) the result of any act or omission of Main Booker, Guests or third parties who are at or in the accommodation with permission.
If care equipment must be used (e.g. an adapted bed, oxygen bottles, a shower chair etc.) during the stay, then the Main Booker must arrange this at his/her own expense and risk. Immediately when making the booking this must be reported to Kasteel Steenenburg (see also article 2.6). Use is only permitted after Castle Steenenburg has expressly agreed to this in writing. Kasteel Steenenburg does not accept any liability for damage to these care resources, or not being able to use these care resources (in time).
Kasteel Steenenburg may require the payment of a deposit at the time of reservation or at the start of the stay. The deposit serves as a guarantee for damage and/or costs -in the broadest sense of the word- which Kasteel Steenenburg may suffer and/or have to incur in the event of non-compliance with the obligations of the Main Booker, Guests and/or third parties forming part of the party.
In case the deposit is not immediately paid, Kasteel Steenenburg is entitled to deny the Main Booker and/or Guests access to and (further) use of the Catering Services.
Moreover, if the payment of the deposit is not made, Kasteel Steenenburg shall be entitled to dissolve the agreement with immediate effect whereby the cancellation fee as stipulated in article 5.5 above shall be due.
The deposit or any balance thereof will be refunded after settlement of claims (damage to inventory, Catering Services and/or other costs) from Kasteel Steenenburg to Head Booker and/or guests. Any (further) claims for damages are not negated by this refund.
In the event that Kasteel Steenenburg is unable - whether temporarily or not - to perform the agreement in whole or in part due to force majeure, within a reasonable period of time after Kasteel Steenenburg has become aware of the impossibility of fulfilling the agreement, a modification proposal will be presented (e.g. for other Catering Services, different period, etc.).
Force majeure on the part of Kasteel Steenenburg shall exist if the performance of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond the control of Kasteel Steenenburg, including, but not limited to, danger of war, (personnel) strikes, blockades, fire, floods and other disturbances or events.
A change proposal need not be accepted. If the change proposal is rejected, this must be communicated to Kasteel Steenenburg within a reasonable time after receipt of the change proposal. In this case, or in the absence of a timely response, Kasteel Steenenburg is entitled to dissolve the contract with immediate effect. There is then the right to remission and/or restitution of (the already paid part of) the booking fee by Kasteel Steenenburg. Kasteel Steenenburg will not be obliged to compensate any damage even then.
Kasteel Steenenburg has the right at any time to terminate the agreement with immediate effect, if it appears that at the time of reservation personal data of the Main Booker and/or Guests are incomplete and/or incorrect. In such a case there will be no refund of the booking price or any part thereof and Kasteel Steenenburg is not liable for any other compensation whatsoever.
Main Booker and/or Guests are responsible for having the valid travel documents required for the destination. Kasteel Steenenburg accepts no liability for the consequences resulting from not having the correct travel documents.
Your own travel or cancellation insurance should be provided.
Obvious printing and typesetting errors, including promotion on or in digital statements, do not bind Kasteel Steenenburg.
The invalidity and/or nullity of one of the individual provisions of these terms and conditions and/or parts thereof does not affect the validity of the remaining (parts of) provisions of these terms and conditions. Amendments and supplements to the agreement and/or terms and conditions are only valid if they are in writing.
The present legal relationship between the parties (and therefore also these terms and conditions) is exclusively governed by Dutch law.
In the event of disputes, the court in the district of East Brabant shall have exclusive jurisdiction, unless the parties expressly agree otherwise in writing. Before the parties submit their dispute to the court, they will make every effort to resolve the dispute among themselves.
